Q. "estate agents & property buyers" What is the relationship?

A. Estate agents are employed to act for the vendor of property and have a duty to work in the best interests of their client. The estate agent main purpose is to get the best price available for the vendor. The estate agent in this scenario does not represent the property buyer. The buyer's agent is employed by the property buyer or renter to act in their best interest. The property buyer's agents main purpose is to secure the best property at the best price. The property vendor is not represented by the buyer's agent.

Q. What do I look for when employing a buyer's agent?

A. In Ireland there is no formal qualification for buyers agents. However, in the auctioneers and house agents act 1947 section 2 it states "a house agent means a person who as an agent for another person for or in expectation of reward purchases …. Or invites offers to purchase or take a letting of, or negotiates for the purchase, letting of a house". It would therefore be advisable to employ a buyer's agent who is licensed as an auctioneer and is also bonded. Also ensure that the buyer's agent has a professional qualification in auctioneering from either the IPAV or IAVI in Ireland.

Q. When a property buyers agent is working for a percentage of the final purchase price can I be sure that the lowest price is being negotiated for me?

A. The buyer's agent has a duty of care to the client to provide the service as advertised the ‘best price available'. The buyer agent business reputation is built on trust and the recommendations of their clients. A professionally qualified agent will not compromise their professional reputation.
